Amparo against awards from replaced labor boards goes to the successor's court

Territorial jurisdiction over direct amparo against the first award issued by a labor board that, under an administrative order, was replaced and whose jurisdiction was modified and assigned to another board located in a different judicial circuit. It lies with the Collegiate Circuit Court with jurisdiction over the successor board.

Official heading (Spanish): COMPETENCIA POR TERRITORIO PARA CONOCER DEL AMPARO DIRECTO CONTRA EL PRIMER LAUDO DICTADO POR UNA JUNTA LABORAL QUE CON MOTIVO DE UN ACUERDO ADMINISTRATIVO FUE SUSTITUIDA Y SU COMPETENCIA FUE MODIFICADA Y ASIGNADA A OTRA UBICADA EN DISTINTO CIRCUITO JUDICIAL. CORRESPONDE AL TRIBUNAL COLEGIADO DE CIRCUITO QUE EJERCE JURISDICCIÓN SOBRE LA JUNTA SUSTITUTA.

The ruling

Several Collegiate Circuit Courts declined territorial jurisdiction over direct amparos against first awards issued by Special Boards of the Federal Conciliation and Arbitration Board that had been replaced by administrative order. The Regional Plenary Court held that the court with jurisdiction over the successor board must hear the case, since that board will carry out the judgment, under article 5, section II, of the Amparo Law.

Our take

The gradual phase-out of the labor boards has produced jurisdictional disputes that delay amparos for months. This ruling sets a rule, but it should be read alongside the full SCJN's binding precedent P./J. 142/2026 (12a.), which places jurisdiction at the seat of the board that issued the award when the change occurs after the amparo is filed. The difference may turn on when the replacement took place. For companies with legacy labor cases, time lost to a misdirected filing translates into accrued back pay and prolonged uncertainty about the exposure.

What to do

  • Compare the date of the board's replacement order with the amparo filing date.
  • Check this ruling against P./J. 142/2026 (12a.) before deciding the competent court.
