Failure to declare a labor award time-barred: the first court hears the amparo

Territorial jurisdiction over indirect amparo against the failure to issue the order or decision declaring that the action to enforce a labor award is time-barred. It lies with the District Court that first took cognizance, since the omission has no material execution.

Official heading (Spanish): COMPETENCIA POR TERRITORIO PARA CONOCER DEL AMPARO INDIRECTO CONTRA LA OMISIÓN DE DICTAR EL ACUERDO O RESOLUCIÓN QUE DECLARE LA PRESCRIPCIÓN DE LA ACCIÓN PARA EJECUTAR UN LAUDO. SE SURTE EN FAVOR DEL JUEZ DE DISTRITO QUE PREVINO EN EL CONOCIMIENTO DEL ASUNTO, AL CARECER DICHO ACTO OMISIVO DE EJECUCIÓN MATERIAL.

The ruling

Two District Courts disagreed on which should hear an indirect amparo against the failure to declare that the action to enforce a labor award was time-barred. The Collegiate Circuit Court held that the court where the complaint was filed must hear it, under the last paragraph of article 37 of the Amparo Law, because the omission has no material execution: the declaration merely recognizes a limitation that has already run.

Our take

The ruling matters mainly to employers holding old awards that workers never enforced. If the labor authority fails to rule on the limitation, the amparo against that omission can be filed with the court in whatever location suits the company, without a territorial dispute. The ruling also makes a useful point: limitation runs by the passage of time and the decision merely formalizes it. Review dormant awards and request the declaration to clear exposures that remain on the books for no reason.

What to do

  • Inventory unenforced awards and determine whether the enforcement period has run.
  • Request a limitation declaration and, if ignored, file an indirect amparo.
