Court-signature precedent does not apply to anti-money-laundering authorities

Confidentiality of the identity and personal data of public officials. Binding precedent P./J. 7/2015 (10a.) does not apply in relation to the Federal Law for the Prevention and Identification of Transactions with Illicit Proceeds.

Official heading (Spanish): RESERVA DE IDENTIDAD Y DATOS PERSONALES DE SERVIDORES PÚBLICOS. INAPLICABILIDAD DE LA JURISPRUDENCIA P./J. 7/2015 (10a.) RESPECTO DE LA LEY FEDERAL PARA LA PREVENCIÓN E IDENTIFICACIÓN DE OPERACIONES CON RECURSOS DE PROCEDENCIA ILÍCITA.

The ruling

In the same case on fines for failing to file vulnerable-activity notices, the company relied on binding precedent P./J. 7/2015 (10a.), on identifying the signer of judicial decisions. The full SCJN held that precedent inapplicable, because the confidentiality rule in the anti-money-laundering law covers administrative authorities.

Our take

This is the companion to the ruling on the constitutionality of article 41. Together, they close the signer-identity argument in anti-money-laundering sanctions. The practical lesson goes beyond this statute: importing precedent from the judicial sphere into administrative acts rarely succeeds unless one explains why the underlying rationale is the same. In our experience, courts draw a firm line between judicial and administrative authorities. Build arguments on precedents involving the same type of authority and the same legal regime.

What to do

  • Review pending defenses that rely on P./J. 7/2015 (10a.) against administrative acts.
  • Support arguments with precedents involving the same type of authority and legal regime.
