Labor claims naming 'whoever is responsible' need no separate conciliation step

Pre-trial conciliation. It need not be exhausted as to 'whoever is responsible for the workplace' when the certificate relating to the fully identified employer is submitted (interpretation of articles 684-B, 684-C, 712 and 872, section B, subsection I, of the Federal Labor Law).

Official heading (Spanish): CONCILIACIÓN PREJUDICIAL. NO ES NECESARIO AGOTARLA RESPECTO DE "QUIEN RESULTE RESPONSABLE DE LA FUENTE DE TRABAJO", CUANDO SE EXHIBE LA CONSTANCIA RELATIVA A LA PATRONAL PLENAMENTE IDENTIFICADA (INTERPRETACIÓN DE LOS ARTÍCULOS 684-B, 684-C, 712 Y 872, APARTADO B, FRACCIÓN I, DE LA LEY FEDERAL DEL TRABAJO).

The ruling

Two Collegiate Circuit Courts disagreed on whether a certificate of failed conciliation must be filed as to the generic party 'whoever is responsible for the workplace' when the claim fully identifies the employer. The Regional Plenary Court held it is not required if the main employer is identified and the corresponding certificate is filed.

Our take

The phrase 'whoever is responsible' is common in labor claims to reach group companies or service recipients. This ruling prevents courts from rejecting or narrowing the claim because no conciliation was held with that generic party. For corporate groups, a single certificate of failed conciliation as to the identified employer opens the door to bringing other entities into the case. Companies should be clear on who formally employs each person and how relationships with service providers or other group entities are documented.

What to do

  • Clearly document each worker's formal employer within the group.
  • Review intra-group specialized service contracts to gauge joint liability exposure.
  • Treat a failed-conciliation certificate for the main employer as an alert for the whole group.
