Juárez University of Durango: vacation premium is paid for each vacation period
Vacation premium. Under clause 34 of the collective bargaining agreement of the Juárez University of the State of Durango, it must be paid for each vacation period.
Official heading (Spanish): PRIMA VACACIONAL. CONFORME A LA CLÁUSULA 34 DEL CONTRATO COLECTIVO DE TRABAJO DE LA UNIVERSIDAD JUÁREZ DEL ESTADO DE DURANGO, DEBE PAGARSE POR CADA PERIODO VACACIONAL.
The ruling
Two Collegiate Circuit Courts disagreed on whether the 18-day vacation premium under clause 34 of the Juárez University of Durango collective agreement is paid once a year or for each vacation period. The Regional Plenary Court held it must be paid for each period actually taken.
Our take
This ruling interprets a specific clause of one collective agreement, but it illustrates a common risk. When a collective agreement ties a benefit to 'the vacation period' without saying whether it is annual, courts tend to read it in the worker's favor. For any employer with a collective agreement, the bargaining round is the time to state precisely the frequency and base of each benefit. An ambiguous clause can multiply a benefit's cost by the number of vacation periods per year.
What to do
- Review collective agreement clauses that tie benefits to periods without stating frequency.
- Clarify the base and frequency of the vacation premium in the next bargaining round.
- Quantify exposure if the current clause allows a per-period reading.
