INFONAVIT records can prove contribution periods IMSS refuses to recognize
Periods recorded in the Comprehensive Contributions System of the Institute of the National Workers' Housing Fund (SIA-INFONAVIT). They constitute direct evidence to the contrary that rebuts the certificate of rights issued by the Mexican Social Security Institute (IMSS) regarding contribution time not recognized by it.
Official heading (Spanish): PERIODOS ASENTADOS EN EL SISTEMA INTEGRAL DE APORTACIONES DEL INSTITUTO DEL FONDO NACIONAL DE LA VIVIENDA PARA LOS TRABAJADORES (SIA-INFONAVIT). CONSTITUYEN PRUEBA DIRECTA EN CONTRARIO QUE DESVIRTÚA LA HOJA DE CERTIFICACIÓN DE DERECHOS EXPEDIDA POR EL INSTITUTO MEXICANO DEL SEGURO SOCIAL (IMSS), RESPECTO DEL TIEMPO DE COTIZACIÓN NO RECONOCIDO POR ÉSTE.
The ruling
IMSS challenged, on direct amparo, an award that relied on SIA-INFONAVIT data to rebut its certificate of rights. The Collegiate Circuit Court held, in binding precedent (jurisprudencia), that those periods are direct contrary evidence and support recognizing the omitted contribution time, under article 18 of the Social Security Law. IMSS keeps its collection powers against employers who failed to comply.
Our take
For workers, this makes it easier to prove contribution weeks. For employers, the risk sits in the last line: if INFONAVIT shows contributions IMSS lacks, IMSS may use its powers against the company. A mismatch between the two systems stops being the worker's administrative problem and becomes the employer's contingency. In our experience, these gaps come from unfiled enrollment movements or payments made through only one channel. Reconciling both platforms periodically costs far less than an IMSS assessment.
What to do
- Periodically reconcile each employee's records at IMSS and INFONAVIT and correct any mismatch.
- Confirm that all enrollment movements were filed with IMSS on time.
- In pension cases, anticipate that IMSS may audit the employer based on this data.
