Consistent witnesses are not enough: labor courts must assess how they know
Witness testimony in labor matters. Factors the authority must consider to assess it rationally.
Official heading (Spanish): PRUEBA TESTIMONIAL EN MATERIA LABORAL. FACTORES DE ANÁLISIS QUE LA AUTORIDAD DEBE CONSIDERAR PARA VALORARLA RACIONALMENTE.
The ruling
An employee sued for unjustified dismissal; the company argued he had stopped showing up a month earlier. The Labor Board ruled for the employer because its witnesses were consistent and uniform. On direct amparo, the Collegiate Circuit Court held that testimony must be assessed rationally: the witness's identity, source of knowledge, circumstances of time, manner and place, and memory processes.
Our take
This goes to the core of many labor defenses. For years, two witnesses repeating the same account were enough. Now the court must ask how they know what they say, what ties them to the parties and whether their account holds up over time. For employers, this calls for witnesses who actually saw the events and honest preparation, not uniform scripts. Our view: the standard is sound and mainly hurts those relying on hearsay witnesses. The best defense remains documentary: attendance logs, access records and dated communications.
What to do
- Choose witnesses who directly saw the events and document their relationship with the parties.
- Strengthen documentary proof of attendance: access records, signed logs and dated communications.
- On cross-examination, probe the opposing witness's source of knowledge and circumstances of time, manner and place.
