Service fees: judges must obtain the authority's internal manuals
Evidence and measures to better inform the decision in indirect amparo. The judge must obtain, on the court's own motion, the internal administrative rules governing the authority's operations when the tax proportionality of a fee for a public service is challenged.
Official heading (Spanish): PRUEBAS Y DILIGENCIAS PARA MEJOR PROVEER EN EL AMPARO INDIRECTO. LA PERSONA JUZGADORA DEBE RECABAR DE OFICIO LA NORMATIVA ADMINISTRATIVA INTERNA QUE FIJA LA OPERATIVIDAD DE LA AUTORIDAD CUANDO SE RECLAMA LA PROPORCIONALIDAD TRIBUTARIA DE UN DERECHO POR LA PRESTACIÓN DE UN SERVICIO PÚBLICO.
The ruling
A company challenged article 39, section VII, of the Puebla State Revenue Law for 2022, which charges a fee for the vehicle ID card for executive transport services. The judge granted amparo on proportionality grounds. On review, the Collegiate Circuit Court ordered the proceeding to be reopened because the internal rules showing how the service operates had not been obtained.
Our take
The ruling cuts both ways. For taxpayers, it eases a hard evidentiary burden: proving what a service costs the State. Against them, the company that had already won its amparo was sent back to the trial court. Our reading is that it is unwise to rely on the judge. In amparo claims against state or municipal fees, offer evidence on the cost of the service from the outset and expressly ask the court to require the authority's manuals. That avoids a late remand and saves time.
What to do
- In fee challenges, ask from the outset that the court require the authority's internal manuals and protocols.
- Gather evidence of the actual procedure the authority performs to compare it with the fee.
