Which Collegiate Court reviews an amparo decided by a Collegiate Appeals Court

Territorial jurisdiction of Collegiate Circuit Courts to hear the review appeal. It lies with the court exercising jurisdiction over the Collegiate Appeals Court that heard the indirect amparo filed against acts of the only counterpart court in its circuit.

Official heading (Spanish): COMPETENCIA POR TERRITORIO DE LOS TRIBUNALES COLEGIADOS DE CIRCUITO PARA CONOCER DEL RECURSO DE REVISIÓN. CORRESPONDE AL QUE EJERCE JURISDICCIÓN SOBRE EL TRIBUNAL COLEGIADO DE APELACIÓN QUE CONOCIÓ DEL JUICIO DE AMPARO INDIRECTO PROMOVIDO CONTRA ACTOS DE SU HOMÓLOGO ÚNICO EN SU CIRCUITO.

The ruling

Regional Plenary Courts disagreed on which Collegiate Circuit Court should hear the appeal against an indirect amparo judgment issued by a Collegiate Appeals Court, when the challenged act came from the only counterpart court in its circuit. The SCJN ruled, in binding precedent (jurisprudencia), that the deciding court acts under ordinary jurisdiction, so the Collegiate Circuit Court with jurisdiction over it hears the appeal.

Our take

This is about court organization, but a misdirected appeal can cost months. Collegiate Appeals Courts replaced the former Unitary Courts after the 2021 reform, and how they fit into the system still raises questions. The SCJN clarifies that, when they hear an amparo against the only counterpart court in their circuit, they act under ordinary jurisdiction, not as auxiliary courts. For companies with federal litigation, the recommendation is simple: confirm which Collegiate Circuit Court will hear the appeal from the moment it is filed.

What to do

  • When filing the appeal, confirm which Collegiate Circuit Court has jurisdiction over the court that ruled.
  • Ask outside counsel to confirm the jurisdictional route in amparo cases against Collegiate Appeals Courts.
  • Monitor docketing to catch any jurisdictional conflict early.
