Environmental amparo: the 2025 reform did not shut out neighbors and communities

Legitimate interest in environmental amparo. The addition of the second paragraph to article 5, section I, of the Amparo Law did not restrict its scope.

Official heading (Spanish): INTERÉS LEGÍTIMO EN EL JUICIO DE AMPARO EN MATERIA AMBIENTAL. LA ADICIÓN DEL PÁRRAFO SEGUNDO A LA FRACCIÓN I DEL ARTÍCULO 5o. DE LA LEY DE AMPARO NO RESTRINGIÓ SUS ALCANCES.

The ruling

A resident of Oaxaca challenged the failure to protect the Benito Juárez National Park. The SCJN Plenary held that the addition to article 5, section I, of the Amparo Law published on October 16, 2025 merely clarified legitimate interest. In environmental cases it suffices to show use of the ecosystem's environmental services, read broadly under the precautionary principle.

Our take

Many companies read the 2025 Amparo Law reform as reducing the risk that third parties could halt projects through environmental amparo. This Plenary ruling dispels that view: environmental legitimate interest remains broad, and a lack of scientific evidence does not defeat it. It affects real estate developers, industry, mining and energy, which are often interested third parties in these cases. Our view: environmental risk should be assessed as a litigation contingency from the feasibility stage, backed by independent technical support and not just the permits obtained.

What to do

  • Include third-party environmental amparo risk in each project's feasibility assessment.
  • Commission independent technical studies on environmental services around the project site.
  • Be ready to appear as an interested third party in any amparo affecting company permits.
