Tax mailbox notices stand even without the time the alert was sent

Electronic notification through the tax mailbox. It is not a legal requirement that the related record state the time at which the tax authority sent the electronic alert to the taxpayer.

Official heading (Spanish): NOTIFICACIÓN ELECTRÓNICA POR BUZÓN TRIBUTARIO. NO CONSTITUYE UN REQUISITO LEGAL QUE LA CONSTANCIA RELATIVA DEBA CONTENER LA HORA EN QUE LA AUTORIDAD HACENDARIA ENVIÓ EL AVISO ELECTRÓNICO RESPECTIVO A LA PERSONA CONTRIBUYENTE.

The ruling

Collegiate Circuit Courts disagreed on whether the tax mailbox notification record must show the time the alert was sent when the taxpayer does not open the document. The Regional Plenary Court held it is not a legal requirement, because the deadlines under articles 17-K and 134, section I, of the Federal Tax Code run by full days.

Our take

This closes a formal argument that had worked in some circuits. Going forward, a deemed tax mailbox notification stands on the date of the alert, and a taxpayer who does not open the mailbox is deemed notified on the fourth day. In practice, the risk lies in contact details: an outdated email or an alert no one reads means lost defense deadlines. Treat the tax mailbox as a critical channel, with assigned owners and daily review. Challenges to notifications should focus on whether the alert was actually sent to the registered contact.

What to do

  • Update contact details registered in the tax mailbox and assign owners.
  • Check the mailbox daily and keep a log of alerts received.
  • When challenging, test whether the alert actually reached the registered contact, not the time.
