The SAT may verify taxpayer registry data without any prior notice being filed
Order for a visit to verify Federal Taxpayer Registry (RFC) data. The power to issue it is discretionary and is not conditioned on a prior change-of-address notice [interpretation of article 27, section C, subsection I, item a), of the Federal Tax Code].
Official heading (Spanish): ORDEN DE VISITA DE VERIFICACIÓN DE DATOS DEL REGISTRO FEDERAL DE CONTRIBUYENTES (RFC). LA FACULTAD PARA EMITIRLA ES DE NATURALEZA DISCRECIONAL Y NO SE ENCUENTRA CONDICIONADA A LA EXISTENCIA DE UN AVISO DE CAMBIO DE DOMICILIO PREVIO [INTERPRETACIÓN DEL ARTÍCULO 27, APARTADO C, FRACCIÓN I, INCISO A), DEL CÓDIGO FISCAL DE LA FEDERACIÓN].
The ruling
A taxpayer filed a change-of-address notice; the authority ordered a verification visit and concluded the change was ineffective. The Regional Chamber annulled the order, reasoning that a prior notice was required. On the authority's appeal, the Collegiate Circuit Court held that the power under article 27, section C, subsection I, item a), of the Federal Tax Code is discretionary and does not depend on a taxpayer notice.
Our take
The authority may show up to confirm that RFC data matches reality without the taxpayer having filed anything. This is a management power, not an audit power, which lowers the formalities required. For companies, the risk is concrete: an address that does not hold up in a verification affects their status in the registry and can trigger further consequences. We recommend treating the tax domicile as an ongoing compliance matter: identifiable staff, available records and the ability to receive the authority without notice.
What to do
- Ensure the registered tax domicile has staff and records available to handle an unannounced visit.
- Appoint responsible personnel and a protocol for RFC verification visits.
- Check that RFC data matches actual operations after any corporate change.
