Labor summons is invalid unless a copy of the notice is in the court file

Service of process in a labor proceeding. For it to be valid, a copy of the notice of service provided in article 751 of the Federal Labor Law must be added to the case file.

Official heading (Spanish): EMPLAZAMIENTO AL JUICIO LABORAL. PARA SU VALIDEZ, DEBE AGREGARSE AL EXPEDIENTE COPIA DE LA CÉDULA DE NOTIFICACIÓN PREVISTA EN EL ARTÍCULO 751 DE LA LEY FEDERAL DEL TRABAJO.

The ruling

A Collegiate Circuit Court and a Regional Plenary Court disagreed on whether it is enough for the court officer's record to state that the notice was delivered, or whether a copy must be added to the file. The SCJN ruled, in binding precedent (jurisprudencia), that the officer must add a copy of the article 751 notice; its absence is a defect that violates the right to be heard.

Our take

For employer defendants, this SCJN binding precedent is a first-rate defensive tool. If an award was issued in a case the company never learned about, checking whether the notice is in the file may open the door to having the proceeding redone. It also has a preventive side: the company should know who receives court papers at each workplace and what they do with them. In our experience, many default judgments stem from mishandled receipt, not defective service. The precedent helps in the second case, not the first.

What to do

  • In default judgment cases, check whether a copy of the article 751 notice is in the file.
  • Appoint a person at each workplace responsible for receiving and routing court notices.
  • Set a protocol to scan and alert the legal team the same day any notice arrives.
