Once the SCJN upholds admission of an appeal, its admissibility is not reopened
Direct amparo on review. As a general rule, the ruling issued in the reclamación appeal regarding its admission constitutes res judicata as to the admissibility requirements.
Official heading (Spanish): AMPARO DIRECTO EN REVISIÓN. POR REGLA GENERAL LA RESOLUCIÓN DICTADA EN EL RECURSO DE RECLAMACIÓN SOBRE SU ADMISIÓN CONSTITUYE COSA JUZGADA RESPECTO DE LOS REQUISITOS DE PROCEDENCIA.
The ruling
The SCJN President admitted a direct amparo on review, finding it raised a constitutional issue of exceptional interest. The petitioner filed a reclamación, and the former First Chamber upheld the admission. Later, the en banc Court asked whether it should revisit admissibility. It held that the reclamación ruling is res judicata on those requirements.
Our take
This ruling brings stability to a stage that used to be uncertain. Previously, a case admitted and upheld on reclamación could still be dismissed years later when the merits were decided. Now, as a general rule, the debate on constitutional issue and exceptional interest closes at the reclamación. For those litigating before the SCJN, this changes where effort goes: the reclamación against admission stops being a formality and becomes the only real chance to contest admissibility. The phrase 'as a general rule' leaves room for exceptions the ruling does not spell out.
What to do
- Treat the reclamación against admission as the only chance to contest admissibility before the SCJN.
- If the opponent did not challenge admission, prepare the merits without expecting a late dismissal.
- Adjust litigation budgets to invest more at the reclamación stage.
