Personal digital sovereignty: a court recognizes it as an emerging right

Personal digital sovereignty. It is an emerging human right essential to safeguard people's privacy, security and integrity against biometric monitoring in surveillance capitalism.

Official heading (Spanish): SOBERANÍA DIGITAL PERSONAL. ES UN DERECHO HUMANO EMERGENTE INDISPENSABLE PARA SALVAGUARDAR LA PRIVACIDAD, SEGURIDAD E INTEGRIDAD DE LAS PERSONAS ANTE EL MONITOREO BIOMÉTRICO EN UN CAPITALISMO DE VIGILANCIA.

The ruling

Ruling on the authority's appeal against a provisional suspension granted in an amparo against article 91 Bis of the General Population Law, which creates a mandatory biometric CURP, the Collegiate Circuit Court held that personal digital sovereignty is an emerging human right, essential to protect people from biometric monitoring under surveillance capitalism.

Our take

This is the court's most ambitious formulation: a right under construction, derived from the principle of progressive realization, that would require structural safeguards and independent oversight. For companies whose model depends on data, such as platforms, analytics-driven retail or fintech, the message is that judicial standards can move faster than legislation. We do not overstate its reach: it is an isolated precedent issued in a ruling on a provisional suspension. But it gives arguments to litigants and regulators. Data governance should be designed to withstand stricter scrutiny than today's.

What to do

  • Map uses of personal and biometric data for profiling or behavior prediction.
  • Build privacy impact assessments into the launch of data-driven products.
  • Track how this line of rulings develops in other courts.
