If the TFJA dismisses without legal basis, the Circuit Court must step in
Supplementing deficient complaints (suplencia de la queja). It applies when the underlying proceeding is dismissed in disregard of the applicable legal framework.
Official heading (Spanish): SUPLENCIA DE LA QUEJA DEFICIENTE. PROCEDE CUANDO SE SOBRESEE EN EL JUICIO DE ORIGEN INOBSERVANDO EL MARCO JURÍDICO APLICABLE.
The ruling
The TFJA dismissed an administrative case on inadmissibility grounds. On direct amparo, the Collegiate Circuit Court found grounds to supplement the deficient complaint and held that this applies when the underlying dismissal disregards the applicable legal framework.
Our take
This isolated precedent applies to nullity actions the same idea found in the binding precedent on improper dismissals. For tax defense it has concrete value: the TFJA often dismisses for untimeliness, lack of standing or non-final acts, and not always correctly. If the dismissal lacks legal basis, the Circuit Court must correct it even if the amparo does not challenge it precisely. Even so, we recommend not relying on supplementing. A well-built argument against every ground for dismissal remains the safest route.
What to do
- Cite this ruling alongside the binding precedent on supplementing in amparos against TFJA dismissals.
- Challenge every ground for dismissal with express legal basis.
- Review recent TFJA dismissals in your portfolio to assess direct amparo.
