Suspension of a labor award in direct amparo: only one shot at a complaint appeal

Complaint appeal (recurso de queja). A second appeal filed against the ruling on suspension of a labor award in direct amparo is inadmissible, as preclusion by exhaustion applies.

Official heading (Spanish): RECURSO DE QUEJA. ES IMPROCEDENTE EL INTERPUESTO POR SEGUNDA VEZ CONTRA LA RESOLUCIÓN QUE PROVEYÓ SOBRE LA SUSPENSIÓN DE UN LAUDO EN AMPARO DIRECTO, AL ACTUALIZARSE LA PRECLUSIÓN POR CONSUMACIÓN.

The ruling

The labor authority granted the employer a suspension of the award challenged in direct amparo without setting a subsistence amount for the worker. The worker, as interested third party, filed a complaint appeal against that ruling, but had already challenged it before, so it was dismissed. The Collegiate Circuit Court confirmed that a second appeal against the same ruling is inadmissible due to preclusion by exhaustion.

Our take

The procedural rule is well known, but the case shows how it works for suspension of an award: the first appeal exhausts the right, even if the second raises a different angle. For employers and workers alike, every objection to the suspension (subsistence amount, security, scope) must be raised in full in a single appeal. Whatever is left out cannot be added later. For the employer's defense, the ruling also helps: if the other side already appealed, a second appeal can be attacked at the outset. We recommend reviewing the amparo file before answering any appeal.

What to do

  • Raise all objections to the suspension ruling in a single complaint appeal.
  • Before answering the other side's appeal, check whether it already challenged the same ruling.
  • Confirm the suspension sets the subsistence amount under article 190 of the Amparo Law.
