Seniority awards are not exempt prizes under article 93 of the Income Tax Law either
Seniority award. It is not equivalent to the prizes provided for in article 93, section XXIV, of the Income Tax Law for purposes of the exemption from that tax.
Official heading (Spanish): PREMIO DE ANTIGÜEDAD. NO SE EQUIPARA A LOS PREMIOS PREVISTOS EN EL ARTÍCULO 93, FRACCIÓN XXIV, DE LA LEY DEL IMPUESTO SOBRE LA RENTA, PARA EFECTOS DE LA EXENCIÓN DEL PAGO DE ESE TRIBUTO.
The ruling
In the same income tax refund dispute, the individual also argued that the seniority award fell within the prize exemption of article 93, section XXIV, of the Income Tax Law. The Collegiate Circuit Court rejected this: that provision covers prizes from scientific, artistic or literary contests open to the public or a profession, or awards recognizing civic values.
Our take
Together with the related ruling on seniority premiums, this closes the second route for exempting a seniority award. Exemptions are read strictly: section XXIV protects open contests and civic recognition, not incentives an employer grants its staff. In practice, any such payment must be withheld on as wage income. For companies with loyalty or work-anniversary programs, the fix is simple, but prior years should be reviewed to gauge exposure for under-withholding.
What to do
- Treat seniority awards as wage income subject to withholding.
- Review withholding on anniversary or loyalty programs for open tax years.
- Document the terms of any prize intended to qualify for the section XXIV exemption.
